These Terms of Service ("Terms") govern your use of QUUIRK's Property Care Wallet™ platform and related services. By using our platform, you enter into a legally binding agreement with QUUIRK.
Our platform connects property owners with verified contractors, public adjusters, and service professionals to facilitate property maintenance, repairs, and improvements through secure, transparent processes.
These terms protect all parties using our platform and ensure fair, secure transactions for everyone.
By accessing and using QUUIRK's Property Care Wallet™ platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
QUUIRK reserves the right to change these terms at any time. We will notify users of any material changes via email or platform notification. Continued use of the service after changes constitutes acceptance of new terms.
You must be at least 18 years old and legally capable of entering into contracts to use our services. By using our platform, you represent and warrant that you meet these requirements.
Our platform connects property owners with verified contractors for maintenance, repair, and improvement services. We provide project management tools, secure payment processing, and quality assurance features.
We conduct background checks, license verification, and insurance validation for contractors. However, users are responsible for their own due diligence and final contractor selection decisions.
Services are available in select geographic areas. We reserve the right to modify service availability, features, or pricing at any time with appropriate notice to users.
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Notify us immediately of any unauthorized use.
Users must provide accurate, current, and complete information when creating accounts and posting projects. False or misleading information may result in account suspension or termination.
Users agree to use the platform only for lawful purposes and in accordance with these terms. Prohibited activities include fraud, harassment, spam, or any illegal activities.
Property owners are responsible for providing safe and legal access to their properties for contracted services and ensuring all necessary permits are obtained.
Contractors must maintain valid licenses, insurance, and professional certifications required for their services. All work must meet industry standards and local building codes.
Contractors agree to complete projects according to agreed specifications, timelines, and budgets. Any changes must be communicated and approved through the platform.
Contractors must participate in our quality assurance program, including customer feedback collection and dispute resolution processes.
Contractors agree to pay platform fees as outlined in their service agreements. Fees may include transaction fees, subscription costs, and premium feature charges.
All payments are processed through our secure payment system. We use industry-standard encryption and PCI-compliant processors to protect financial information.
For eligible projects, we offer escrow services to protect both property owners and contractors. Funds are held securely until project milestones are completed.
Refunds are handled on a case-by-case basis according to our dispute resolution process. Platform fees may be non-refundable except in cases of platform error.
Users have 30 days from the date of charge to dispute billing issues. All disputes must be submitted through our customer support system.
QUUIRK owns all rights to the platform, including software, design, trademarks, and proprietary algorithms. Users may not copy, modify, or distribute our intellectual property.
Users retain ownership of content they upload but grant QUUIRK a license to use, display, and distribute such content for platform operations and marketing purposes.
The QUUIRK name, logo, and Property Care Wallet™ are registered trademarks. Unauthorized use of our trademarks is strictly prohibited.
QUUIRK provides a platform for connecting users with contractors but is not responsible for the quality, safety, or legality of services performed by contractors.
Our liability is limited to the amount of fees paid to QUUIRK in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
QUUIRK is not liable for delays or failures due to circumstances beyond our control, including natural disasters, government actions, or technical failures.
We encourage users to first attempt resolution through our customer support system. Our team will mediate disputes and work toward fair solutions.
Disputes that cannot be resolved internally will be subject to binding arbitration under the rules of the American Arbitration Association.
Users agree to resolve disputes individually and waive the right to participate in class action lawsuits or collective arbitration proceedings.
Either party may terminate their account at any time. QUUIRK reserves the right to suspend or terminate accounts for violations of these terms.
Upon termination, users lose access to the platform and their data may be deleted according to our data retention policy. Outstanding obligations remain in effect.
Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination of these terms.
These terms constitute a legally binding agreement. If you do not agree with any part of these terms, you must not use our services. Your continued use of the platform indicates your acceptance of these terms and any future modifications.
